In Texas, the eviction process can be confusing. Often, tenants who have received an eviction judgment don’t know their legal rights, which can make the process more stressful. This website teaches you about the eviction appeals process so that you can stand up for your rights in the eviction process.
IMPORTANT: If you have already attended your eviction hearing and you received an eviction judgment, you have 5-calendar days (including weekends and holidays) from the date the eviction judgment was signed to file an appeal. This 5-calendar day deadline may not be extended under any circumstances.
Tenants facing eviction have a right to file an appeal. By filing an appeal in your eviction case and meeting certain appeal deadlines, you can get the most time available to you under the law.
If you were evicted for non-payment of rent, we recommend that you start by watching the video about the non-payment of rent eviction appeals process, which explains the process as well as how to file an appeal.*** This website also includes the forms you need to file your appeal and additional legal resources to help you navigate the eviction appeal process.
***IMPORTANT: The eviction appeal requirements are different if you were evicted for a lease violation or holdover. For more information on what steps, you must take to appeal an eviction based on a lease violation or holdover, click here.
This website was developed by SALSA’s Housing & Homelessness Team (Kristen Adams, Clarissa Galindo and Casey Dunn) as they were helping tenants facing eviction at Bexar County Justice of the Peace Court 1 (JP1) from 2023-2024. The team assisted thousands of tenants with navigating the eviction appeals process and educating them about their legal rights. They hope that the information provided in this website is helpful to those who need it.
